La plupart des commentateurs interprète le principe de l'identité des indiscernables comme principe purement logique, mais avec des implications métaphysiques, et donc, selon l'interprétation commune, comme fausseté ou vérité contingente ou triviale. Je soutiens, au contraire, que le principe, selon Leibniz, est vrai, mais que cette vérité n'est triviale ni contingente, mais nécessaire dans un sens métaphysique. Leibniz tent à démontrer la nécessité du principe dans deux manières : une manière logique et une manière métaphysique . Je soutiens que seule (...) la manière métaphysique peut réussir, et que la négligeance de cette manière aboutit au malentendu de ce principe. (shrink)

Nach einer allgemeinen Diskussion des Zusammenhanges zwischen theoretischer und experimenteller Forschung, wird in Hinblick auf die vom Verfasser entwickelten physikalisch-mathematischen Grundlagen der Biologie, eine Reihe von Einzelproblemen betrachtet. Es wird an Hand von Kurvenmaterial gezeigt wie weit die mathematisch vorausgesagten Beziehungen mit den experimentellen Befunden übereinstimmen. Folgende Fragen werden besprochen: Zellatmung, Zellgrössen, deren Abhängigkeit von Stoffwechsel, Zellteilung, Protoplasmaströmungen, Nervenerregung, psychophysische Gesetze, Reaktion auf geometrische Gestalten.Après une mise au point générale de la relation entre les sciences théoriques et expérimentales, diverses questions (...) sont discutées, du point de vue des fondations physico-mathématiques de la biologie, développées récemment par l'auteur. On montre par la comparaison des courbes calculées à celles observées, comment les relations prédites mathématiquement se trouvent vérifiées. Les questions suivantes sont discutées: respiration cellulaire, dimensions cellulaires et leur rapport au métabolisme, division cellulaire, mouvements protoplasmiques, excitation nerveuse, les lois psychophysiques, perception des formes géométriques. La singularité du droit pénal, selon Durkheim tient au fait que l'adage « nul n'est censé ignorer la loi»s'y applique sans fiction. Cette connaissance toujours déjà assurée des sujets sociaux que le droit pénal suppose, quel statut lui donner? Et quelle forme particulière de sanction s'en trouve par là déterminée? En étudiant les transformations de la réflexion sociologique sur ce sujet, de Durkheim à Fauconnet, on voudrait poser les jalons d'une conceptualisation du droit pénal qui, sans quitter le plan proprement (...) juridique et sans le réduire à n'être que le reflet ou l'instrument de motivations extérieures, s'efforce de saisir le type de prise qu'il exerce sur les événements et les corps, la façon dont il les dissocie et les réarticule, le découpage qu'il opère dans la réalité avec une précision et une exactitude qui n'ont rien d'absolu, puisqu'au fond, elles ne relèvent que de lui. Psychology was born and evolved over the course of centuries in the bosom of philosophy, from which it separated to become an experimental science. However, not many are familiar with the period in the middle of our century when psychology and philosophy were united, a period that to a large extent defined the philosophical-methodological distinctiveness of our psychological science in comparison with world psychology. Today this uniqueness is ascribed exclusively to the influence of Marxism and, because of the current revisions (...) of Marxism, a number of psychologists are proposing that the philosophical-methodological foundations of our psychology be discarded and that the discipline be returned to the stream of pure scientism. However, it is worth noting that Russian culture has always had a distinctive orientation in its philosophy and worldview. Hence the influence of Marxism on the development of psychology had historical presuppositions of its own and cannot be reduced to purely ideological factors. The way it produces ideas and hypotheses, the way its scientists think, as well as the formulation of psychological knowledge make our psychology a philosophical discipline. (shrink)

An approach to constructing counterparts of some fields of mathematical analysis in the frames of Pilbert's “finitary standpoint” is sketched in this paper. This approach is based on certain results of functional spaces theory development in classical mathematics.

Stiff Person Syndrome is a rare autoimmune disorder associated with antibodies against glutamic acid decarboxylase, the key enzyme in γ -aminobutyric acid synthesis. In order to investigate the role of cerebral benzodiazepinereceptor binding in SPS, we performed [ 11 C]flumazenil positron emission tomography in a female patient with SPS compared to nine healthy controls. FMZ is a radioligand to the postsynaptic central benzodiazepine receptor which is co-localized with the GABA-A receptor. In the SPS patient, we found a global reduction of (...) cortical FMZ binding. In addition, distinct local clusters of reduced radiotracer binding were observed. These data provide first in vivo evidence for a reduced postsynaptic GABA-A receptor availability which may reflect the loss of GABAergic neuronal inhibition in SPS. (shrink)

Background: Discussing treatment risks has become increasingly important in medical communication. Still, despite regulations, physicians must decide how much and what kind of information to present. Objective: To investigate patients’ preference for information about a small risk of a complication of colonoscopy, and whether medical and personal factors contribute to such preference. To propose a disclosure policy related to our results. Design: Vignettes study. Setting: Department of Gastroenterology, Academic Medical Centre, the Netherlands. Patients: 810 consecutive colonoscopy patients. Intervention: A home-sent (...) questionnaire containing three vignettes. Vignettes varied in the indication for colonoscopy, complication severity and level of risk. Patients were invited to indicate their wish to be informed and the importance of such information. In addition, sociodemograhic, illness-related and psychological characteristics were assessed. Main outcome measurements: Wish to be informed and importance of information. Results: Of 810 questionnaires, 68% were returned. Patients generally wished to be informed about low-risk complications, regardless of the indication for colonoscopy or the severity of the complication. The level of risk did matter, though (OR = 2.48, SE = 0.28, p = 0.001). The information was considered less important if done for population screening purposes or diagnosis of colon cancer, if the complication was less severe (bleeding) and if the risk was smaller (0.01% and 0.1%). Patients’ information preference was also related to age, mood and coping style. Limitations: Difficulty of vignettes. Conclusions: Patients generally wish to be informed about all possible risks. However, this might become uninformative. A stepwise approach is suggested. (shrink)

Face au jusnaturalisme et aux courants majeurs du positivisme juridique, l'école du réalisme juridique scandinave occupe une place singulière dans la philosophie du droit. L'ouvrage du grand juriste suédois Karl Olivecrona (1897-1980), De la Loi et de l'Etat, constitue l’une des meilleures illustrations de cette approche et une œuvre majeure de la doctrine suédoise. Après avoir été édité en anglais en 1939 sous le titre Law as fact, il fut publié en Suède en 1940 dans une version plus complète. Déniant (...) tout fondement métaphysique au Droit, l’auteur se prête à un exercice de déconstruction et de reconstruction de l’architecture de l’ordre juridique dans son intégralité afin de parvenir, selon ses propres termes, à une explication conséquente et cohérente des faits désignés par la notion d’ordre juridique. Le mouvement doctrinal du réalisme scandinave, qui a exercé une forte influence sur la pensée juridique suédoise et accompagné le déploiement de la social-démocratie et la construction de la société suédoise moderne, est aujourd’hui remis en question. Le meilleur indice n’en est-il pas fourni par les bouleversements que subit la société post-moderne suédoise, avec notamment le recadrage de l’Etat-providence en Etat de droit, sous l'influence de divers facteurs, en particulier le processus d’européanisation du droit?
